THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.398 of 2016 ORDER:

This Contempt Case is filed alleging non-implementation of the order in W.P.No.14921 of 2015 dated 14.09.2015. This Court, in a batch of cases in W.P.No.12949 of 2015 and batch, passed an order setting aside the notification challenged in the said batch of cases for appointment of fair price shop dealers with liberty to the respondents to issue a fresh notification as per the roster register submitted to this Court in respect of Kurnool Revenue Division. Learned Counsel for the petitioner submits that the fresh notification is issued only in respect of 75 shops, whereas the earlier notification was issued in respect of 84 shops. The issuance of notification for a lesser number of shops cannot be construed as violation of the order of this Court and if the petitioner is aggrieved for not notifying any particular shop, it is always open to the petitioner to take appropriate proceedings in accordance with law, but not by way of contempt proceedings.
