THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20239 of 2019 O R D E R:

Petitioner asserts that the Government issued Laoni Patta as well as pattadar pass books in his favour with respect to agricultural land admeasuring Acs.2.00 in Survey No.216/1/44 of Kattalingannapet Village, Chandurthi Mandal, Rajanna Sircilla District. While so, at the instance of respondent No.6-Sarwaka Trust, respondent No.4-Tahsildar, Chandurthi Mandal, is interfering with his possession over the subject land. Hence, he filed this writ petition. Learned Government Pleader for Revenue submits that the petitioner was issued pattadar pass books with respect to the subject land.

Learned Government Pleader for Home placed before this Court the written instructions received from the Assistant Sub-Inspector of Police, Chandurthi Police Station, Rajanna Sircilla District on, 17.09.2019, and stated that respondent No.6, which is running an old-age home, was assigned Acs.5.00 of land in Survey No.216; that they planted saplings and trees under Harithaharam; that the petitioner, who was the head of the Village, has trespassed into the land on 15.07.2019 and destroyed the plants and that the villagers have also confirmed the allocation of the land to respondent No.6. Along with the written instructions, the Sub-Inspector of Police filed a copy of Crime Details Form, wherein

it is stated that the land in Survey No.216 is a vast extent and the land of the petitioner is adjacent to the land of respondent No.6. In view of the above, it is clear that there are boundary disputes between the petitioner and respondent No.6 with respect to the subject land. Inasmuch as the investigation is going on, if any observation is made by this Court, the same may affect either the petitioner or respondent No.6.

As there appears a dispute with regard to the identification of the property and boundaries, the writ petition is closed giving liberty to the petitioner to approach the civil Court seeking appropriate injunctive relief.
