HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28605 OF 2016 ORDER:

The case of the petitioner is that he made application through Mee Seva vide Application No.TAMU011602562188 on 06.07.2016 for mutation and issuance of E-Pass Book to the 3rd respondent by paying necessary fee and the same is rejected on 30.07.2016 without issuing notice to the petitioner under Section 5(3) of the A.P.Rights in Land and Pattadar Pass Books Act, 1971. Aggrieved by the same present writ petition is filed.

Heard learned counsel for the petitioner.

Time was sought by the Learned Assistant Government Pleader for Revenue on 02.09.2016 for producing the rejection order. Today when the matter listed, learned AGP again sought time.

A perusal of the rejection order filed along with the writ petition shows that the same is passed without any reasons except using the words 'rejected', which goes to show that the same is passed without application of mind. No separate rejection order is produced by the learned Assistant Government Pleader.

In view of the same, the impugned rejection order dated 30.07.2016 is set aside and the 3rd respondent is directed to

consider the application of the petitioner after issuing a notice to the petitioner in accordance with law within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
