HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.865 OF 2015 O R D E R :

The contempt case is filed alleging violation of the orders dated 18.02.2015 passed by this Court in WP.MP.No.4517 of 2015 in WP.No.3406 of 2014. The order passed by this Court on 18.02.2015 in WP.MP.No.4517 of 2015 is as follows; "....the 3rd respondent is directed to consider the representation of the petitioner dated 27.01.2015, and pass orders within a period of one week from the date of receipt of a copy of this order and take action in accordance with law."

Learned counsel for the petitioner submits that inspite of directions by this Court, no orders are passed by the respondents on the petitioner's representation.

The respondent filed counter affidavit stating that they have demolished 4th floor portion after issuing statutory notice to the 4th respondent under Sec.452(1) and Sec.636 of HMC Act and that the 4th respondent filed OS.No.18/2015 and obtained status-quo orders. Learned Standing Counsel for the respondent Corporation also produced proceedings dated 23.02.2015 before this Court stating that petitioner's representation was considered and that they will take further action after vacating the orders passed by the Civil Court in IA.No.7/2015 in OS.No.18/2015. In view of the above, I do not see any violation of the orders passed by this Court by the respondent, as such, the Contempt Case is dismissed. However, it is open for the petitioner to approach Civil Court and get the interim order passed in IA.No.7/2015 vacated. After vacating the interim orders, it is for

the respondents to take further action in the matter. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the contempt case, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 08.07.2015 t k.
