THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4584 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents, more particularly 4th respondent in not issuing permits/transit passes for lifting and transportation of sand of 1,12,200 cbms from Agraharam - Mulapadu Reach, Devipatnam (M), East Godavari District in terms of allotment made by the 2nd respondent in Proceedings.No.C/236/2014, dt.23-02-215 as arbitrary, illegal, unjust, unconstitutional and contrary to the A.P. Minor Mineral Concession Rules, 1966 and pass such other order or orders as the Hon'ble Court deems fit and proper in the interest of justice."

When the matter came up for hearing on 12.02.2016, the learned Assistant Government Pleader for Mines and Geology stated that the allotment of Agraharam Mulapadu sand reach to the petitioner was terminated with immediate effect under proceedings No.C/236/2014 dated 01.02.2016 of the District Collector, East Godavari District. A copy of the said proceedings was also placed on record.

Today, the learned Assistant Government Pleader informed this Court that the termination proceedings dated 01.02.2016 were separately subjected to challenge by the petitioner - society before this Court.

In the light of the afore-stated developments, the cause in this writ petition does not survive for consideration. The writ petition is accordingly dismissed leaving it open to the petitioner to pursue its remedies in relation to the subsequent cause of action in accordance with law.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
