The petitioner presents a grievance against the fixation of maximum internal assessment marks as 320 [75%] instead of 425 marks as arbitrary and illegal.

2. The first respondent, pursuant to the notice of this court filed detailed counter-affidavit setting out the procedure followed in the case of Multipurpose Health Workers [Female] Training Institute.

3. The issue in the case on hand is the applicability of 75% marks to the

students admitted on 01/03/2013 in the course meant for tenth class students with eighteen months duration. Admittedly the representation dated 22/1/2015 filed by the petitioner on the issue on hand, in his capacity as President is pending decision.

4. At this stage of the matter without examining the case on merits, I consider it appropriate to leave it open to the first respondent to consider the representation dated 22/01/2015 within a period of two weeks from the date of receipt of a copy of the order and take decision in accordance with law and applicable rules. The petitioner or any institution if is aggrieved by any decision can avail the legal remedy. The petitioner is given one week time from today to file additional representation/material if any supporting continuation of 100% internal marks in so far as candidates admitted with tenth class as qualification.

5. With the above direction, the Writ Petition is disposed of. No order as to costs.

6. As a sequel, Miscellaneous Petitions if any, pending in this writ petition shall stand closed.
