Heard counsel for the petitioner and the Government Pleader for Transport appearing for respondents 1 & 2. 2.

Both the counsel submit that this court in similar circumstances passed order dt.20.01.2016 in W.P.No.1503 of 2016.

Having regard to the order dt.20.01.2016 in W.P.No.1503 of 2016 and for the reasons alike, this Writ Petition is also disposed of directing that in case the petitioner insists that his vehicle be released for major repairs and he is not able to replace it without another vehicle, the respondent shall accede to such request and he may, in turn, grant transport permit on the same route in favour of the owner of another vehicle, in accordance with. Consequently, the impugned order is set aside. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand dismissed.
