THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.16018 of 2017 ORDER:

This Writ Petition is filed for not giving an opportunity to the petitioner for submitting a reply pursuant to the notice issued by the second respondent addressed to one Boya Mohan Das, who died after receiving the notice.

A reading of the notice states that the vehicle belonging to Mohan Das was seized pursuant to registration of Crime No.12 of 2017 in exercise of the powers conferred under the Andhra Pradesh Minor Mineral Concession Rules, 1966, and an amount of one lakh rupees was imposed as penalty on 26.02.2017. It is also stated that the vehicle has to be confiscated for the offence committed under the aforesaid Rules. The said Mohan Das was asked to explain within ten days as to why the vehicle should not be confiscated. Since the said Mohan Das expired, the petitioner claiming to be the representative/owner of the vehicle wants to participate in the proceedings and submit his representation.

In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit his explanation to the notice issued by the second respondent on 28.02.2017, within a period of one week from the date of receipt of a copy of this order, and on receipt of the said explanation, the second respondent shall pass appropriate orders in accordance with
