HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43231 OF 2016 ORDER:

The case of the petitioner is that petitioner was assigned an extent of Ac.3-00 gts in Sy.No.41/64, situated in Garepally Village, Kataram Mandal, Jayashankar Bhoopalapally District and the same was acquired by the respondent authorities along with other individual patta holders for formation of new tank under Kateshwaram Lift Irrigation Scheme. Thereafter the respondent No.5 addressed proceedings in Lr.No.B/112/2011, dated 10.04.2015 to the 4th respondent for fixing the ex-gratia amount for the lands acquired. In the said proceedings, though the petitioner's name was mentioned at Sl.No.3 and awarded an amount of Rs.10,50,000/-, the said amount was not paid. As such, the petitioner made a representation dated 22.08.2016 for release of the said amount. As no action has been taken, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Government Pleader for Land acquisition.

A perusal of the proceedings dated 10.04.2015 sent by the 5th respondent to 4th respondent goes to show that the petitioner name was shown at Serial No.3 and against his name, an amount of Rs.10,50,000/- is mentioned. Since it is stated that petitioner has already made a representation to 4th respondent, it is for the respondents to consider the same and pass orders in accordance with law.

In view of the same, the 4th respondent is directed to dispose of the representation made by the petitioner on 22.08.2016 within a period of eight (08) weeks from the date of receipt of copy of the order and take action accordingly.

With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-12-2016 dv
