THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.4526, 4537 and 4542 of 2015 COMMON ORDER:

Alleging inaction on the part of the respondent-authorities in considering their applications for regularization of the lands in their occupation, these writ petitions are filed. The subject matter of these writ petitions being similar, they are being disposed of by this common order.

The common case of the writ petitioners is, they are in occupation of different extents of lands in Survey No.143 of Kothagudem town, Khammam district. They state that their fathers inhabited the said lands since 1970s and now they came to be in occupation and they were allotted house numbers and are also paying relevant taxes. It is their case that the Government, with a view to regularize the lands occupied in Survey Nos.141, 142 and 143 of Kothagudem village and mandal, issued G.O.Ms.No.373, Revenue (Ass.VII) Department, dated 24.03.2005; consequent to which they submitted applications seeking regularization of their lands, but their applications were not acted upon till this day.

At the hearing, learned Assistant Government Pleader, on instructions, submits that out of 11,287 applications received from various persons for regularization of lands in their occupation in Survey Nos.141, 142 and 143 of Kothagudem town, 4700 applications have been disposed of and the remaining applications are being processed. He states that the applications are processed in seriatim, based on seniority and eligibility, and as certain malpractices have come to notice on earlier occasions, necessary verification and enquiry at the ground level is being conducted, and hence there is certain delay.

In view of the submission made by the learned Assistant Government Pleader, the writ petitions are disposed of, without expressing any opinion on the eligibility or otherwise of the petitioners. However, the respondent authorities shall process their applications, in due course, in accordance with law. No costs. Miscellaneous petitions, if any pending in these writ petitions, shall stand closed.
