THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 3083 of 2017 ORDER:

1) The present writ petition came to be filed with the following prayer:

" to issue an order or direction more in the nature of mandamus to declare the action of the Respondents in not referring the matter to the competent civil Court under Section 30 of the Land Acquisition Act and Section 76 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 in connection with lands of the petitioner admeasuring Ac.0.05 gts., in Sy.No.5/ a, Ac.0.05 gts., in Sy.No.5/ aa, Ac.0.05 gts., in Sy.No.5/ e, Ac.0.03 gts., in Sy.No.6/ a, Ac.0.03 gts., in Sy.No.6/ aa, Ac.0.03 gts., in Sy.No.6/ e, Ac.0.03 gts., in Sy.No.6/ ee, Ac.0.1550 gts., in Sy.No.6/ vu, Ac.0.1550 gts., in Sy.No.6/ vuu, Ac.0.20 gts., in Sy.No.9/ 1, Ac.1.02 gts., in Sy.No.12/ 1, Ac.2.00 gts., in Sy.No.13/ a/ 1, Ac.0.20 gts., in Sy.No.

11/ a/ 1 of Sridharaveleru Village of Kukkunur Mandal, which are sought to be acquired vide notification Roc.No.E/ 410870/ 2016/ R/ R, dated 03.12.2016, published in Eenadu Telugu Daily, to pay compensation to respondent Nos.

2) It is represented by the learned counsel for the petitioner that the issue involved in the writ petition is squarely covered by an order of this Court, dated 14.03.2016, rendered in W.P.No.46105

of 2016, the same is not disputed by the learned Government Pleader for Land Acquisition.

3) In that view of the matter, following the order dated 14.03.2016 passed in W.P.No.46105 of 2016, this writ petition is disposed of giving liberty to the petitioner and to the respondent Nos.6 to 14, to raise their respective claims before the third respondent, in which event the same shall be considered in accordance with law. There shall be no order as to costs.

4) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
