THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.20542 OF 2019 ORDER:

This writ petition is filed questioning the inaction of respondent No.3-Station House Officer, Banjara Hills Police Station, Hyderabad, in not registering the complaint of the petitioner dated 15.08.2019, which was acknowledged by 3rd respondent on 20.08.2019, as illegal and arbitrary and consequently to direct the 3rd respondent to register the said complaint.

Heard Sri Subramanyam Daraboina, learned counsel for the petitioner and the Assistant Government Pleader for Home appearing for respondent Nos.1 to 3.

On written instructions dated 18.09.2019, the learned Assistant Government Pleader for Home would submit that based on the complaint dated 15.08.2019 made by the petitioner, an entry in General Diary, vide G.D.No.19/185, was made and investigation was conducted. Based on such investigation, it is found that no offence has occurred and accordingly the case is closed. He would further submit that the petitioner and her family are making such false allegations in order to escape the liability in criminal cases registered against them in Banjara Hills and Nallakunta Police Stations.

The learned counsel for the petitioner would submit that on 09.10.2019 the petitioner has also been informed about the closure of the complaint made by her. In view of the above submissions made by both the parties, the grievance of the petitioner in the present writ petition does not survive for adjudication and therefore, the writ petition has become infructuous.

Accordingly, the writ petition is dismissed as infructuous by granting liberty to the petitioner to avail the remedies available to her under law. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 16.10.2019 Isn
