This Writ Petition is filed seeking to issue writ of mandamus declaring the proceedings No.P2/684 (01)/2001/RM/GNT, dated 28.04.2001, passed by the 2nd respondent, as arbitrary and contrary to their own circulars and consequently direct the respondents to pay the additional monetary benefits as per the Circular, dated 13.11.1989, issued by the respondent-Corporation. 2.

Heard Sri N.Venkateswarlu, learned counsel for the petitioner and Sri P.Durga Prasad, learned Standing Counsel for the respondent-Corporation.

It has been contended by the petitioner that her husband died while he was working as Conductor on 13.05.1998, and as per the Circular, dated 12.03.2001, the petitioner is entitled for additional monetary benefits and accordingly, she has submitted a representation to the respondents on 13.03.2001 claiming additional monetary benefits, but, the respondents are not paying the same. Challenging the same, the present Writ Petition has been filed.

It has been contended by the learned Standing Counsel that as per the Rules, if the petitioner is entitled for any additional monetary benefits, respondent-Corporation will pay the same to the petitioner, if not already paid.

This Court, having considered the rival submissions made by the parties, is of the view that ends of justice would be met if a direction is given to the respondent-Corporation to consider the

case of the petitioner for additional monetary benefits in terms of Circular, dated 13.11.1989, and any other circular, if applicable 6.

Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to consider the case of the petitioner for additional monetary benefits in terms of Circular, dated 13.11.1989, and any other Circular, if applicable, and pass appropriate orders, in accordance with the Rules, within a period of four (4) weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending if any, shall stand closed. No costs.
