The petitioner prays for the following relief: "...to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the action of the respondents in constructing the drainage through the road margin on the northern side of my house bearing D.No.7-76, Narasannapet, Garagaparru Grampanchayat, Palakoderu Mandal, West Godavari District without any need or necessity and without any requisition or resolution by the Grampanchayat, as illegal, arbitrary and contrary to the law ..."

Heard counsel for petitioner and Government Pleader for Panchayat Raj and perused the material placed on record. The grievance of petitioner is that the respondents are proposing to dig a drain in the margin of panchayat road on the northern side of petitioner's house without a resolution of Grampanchayat..

In the facts and circumstances of the case, no substantial ground is urged by the petitioner to consider the writ prayer. Further, the writ petition is filed on mere apprehension. Therefore, I am of the view that the writ petition fails and is dismissed. No order as to costs.
