THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.2944 of 2015 ORDER :

The petitioner preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 03-10-2015 passed in Crl.M.P.No.127 of 2015 in S.C.No.34 of 2012 by the XIII Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar, wherein and whereby the learned trial Judge allowed the application filed by the de facto-complainant for examination of L.Ws.8 and 9 by Video Conference. This Court by order dated 01-12-2015 directed the trial Court not to proceed insofar as L.Ws.8 and 9 are concerned. The 02nd Respondent - de facto-complainant preferred a petition to vacate the said order.

Heard and perused.

The learned counsel for the 02nd Respondent submitted that even though an order was passed for examination of L.Ws.8 and 9 by video conference, the said witnesses now came to India and they will be in India up to 23-12-2015 and also they are willing to give evidence before the trial Court if a date is fixed by this Court.

Considering the said facts and circumstances and as the

learned counsel for the petitioner informed this Court that the counsel for the petitioner will not be available from 25-12-2015 to 12-01-2016 and since L.Ws.8 and 9 have come all the way from United States of America and in the interest of justice, the Criminal Revision Case is disposed of with the following directions :

L.Ws.8 and 9 in S.C.No.34 of 2012 are directed to be present on 22-12-2015 before the Court concerned for examination in chief and cross. The counsel for the petitioner herein is also directed to be present on that day and without taking any adjournment, he is directed to cross-examine the said witnesses on the same day. The said witnesses also to be present without fail on 2212-2015 before the concerned Court. The learned trial Judge is directed to give priority to this case in view of the present facts and circumstances and examine the witnesses on the date so fixed.

Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, in this revision shall stand closed.
