THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21797 of 2017 ORDER:

Heard Sri Kiran Tirumalasetti for petitioner and the Assistant Government Pleader (Revenue) for respondents 1, 3 and 4. The petitioner challenges notice issued in Form A-1 under Board Standing order 15 paragraph '6' calling upon objections from all the persons, who have interest in survey numbers shown in the schedule appended to the notice impugned in the writ petition. On instructions, the Assistant Government Pleader for Revenue submits that the notice impugned in the writ petition is first stage of consideration of request of the 2nd respondent and the details now shown in the notice shall not be treated as a conclusive or final. On the individual claims, it is stated that the 4th respondent is under obligation to consider all the objections including the objections the petitioner raises in this behalf. The statement is placed on record.

After perusing the procedure contemplated under paragraph '6' of the Board Standing Order 15, this Court is prima facie satisfied that interference at this stage of the matter is not warranted.

Hence, the writ petition is disposed of by giving liberty to petitioner to re-submit explanation or file additional explanation by enclosing a copy of this order, so that the respondents can consider

the objections as stated supra. The petitioner, if aggrieved by the decision, can certainly work out legal remedies before competent forum.

The writ petition is disposed of accordingly. No order as to costs.
