The transfer criminal petition is filed seeking transfer of the MC.No.39 of 2015 from the file of the II Additional Judicial First Class Magistrate, Kakinada to the Family Court, Rajahmundry, East Godavari District to be tried along with OP.No.48 of 2016. 2.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the first respondent. None appears for the respondents 2 to 4 in spite of notice.

The counsel for the petitioner submits that earlier the petitioner filed divorce petition in OP.No.1830 of 2014 on the file of the Judge, Family Court, Ranga Reddy District at L.B. Nagar, which was transferred to the Family Court, Rajahmundry, at the instance of the second respondent herein, vide Tr.CMP.No.679 of 2015 dated 31.12.2015.

Hence, it would be convenient for the petitioner to attend both the cases in the same Court. The copy of the aforesaid order in is also filed by the counsel for the petitioner.

The transfer criminal petition is allowed and MC.No.39 of 2015 is withdrawn from the file of the II Additional Judicial First Class Magistrate, Kakinada and transferred to the Family Court, Rajahmundry, East Godavari District to be tried along with OP.No.48 of 2016. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
