THE HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7343 of 2016 ORDER:
The petitioners are A2 to A4 among other four accused including husband of the defacto complainant - A1, who was granted bail vide order in Crl.M.P.No.1533 of 2016 dated 22.03.2016 by the Judicial Magistrate of First Class, Special Mobile Court, Guntur in Crime No.83 of 2016 of Nallapadu Police Station, Guntur, registered for the offences punishable under Sections 494, 495, 420 and 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act.
2. Heard the Learned Counsel for the Petitioners, the Learned Additional Public Prosecutor for the Respondent-State (A.P.) and perused the material placed on record.
3. It is the submission that already A1 obtained divorce in F.C.O.P.No.47 of 2012, which is a consent divorce against the alleged another wife, which was dated 23.07.2012. The marriage of the A1 with defacto complainant was shown performed subsequently on 18.10.2013 at Padmavathi Kalyana Mandapam, Tenali.

Having regard to the circumstances stated in the petition as well as submissions made, this application is disposed of, by giving liberty to the petitioners-accused Nos.2 to 4 to surrender before the Learned Magistrate, with notice to learned Assistant Public Prosecutor concerned and move for regular bail, in which event, the learned Magistrate shall grant bail on the same day with necessary conditions.
