ORDER:
This writ petition is filed for the following substantive relief: "......to issue any writ, order or direction more particularly one in the nature of writ of Mandamus declaring the resolution dated 30.03.2011 passed by respondent No.1 society thereby removing the petitioners from the posts of Secretary and Directors respectively of the respondent No.1 society as arbitrary, illegal, bad in law, contrary to Section 21A of the A.P. Cooperative Societies Act, 1964, principles of natural justice and consequently by setting aside the resolution dated 30.03.2011 of the respondent No.1 society, direct the respondents herein to permit the petitioners to discharge their duties as secretary and directors respectively of respondent No.1 society and pass such other further order or orders ...."
On 30.06.2015, there was no representation for the petitioners. Therefore, the case was adjourned to today for being posted under the caption "For Dismissal". Accordingly, the case has been posted under the said caption. Even today, the counsel for the petitioners is not present.
Smt.B.V.Aparna Lakshmi, learned counsel representing Mr.C.V.Bhaskar Reddy, learned counsel for respondent No.1, submitted that as per her instructions, elections for the new managing committee were held on 06.05.2015 and therefore, the cause in the writ petition does not survive for adjudication. The learned Assistant Government Pleader for Fisheries submitted that the term of the managing committee is going to end by 02.07.2015. Going by the respective submissions of either of the counsel, I am of the opinion that the cause in the writ petition does not survive for adjudication as the term of the managing committee to which the petitioners were elected has come/is coming to an end either on account of holding of fresh
elections stated to have been held on 06.05.2015 or on expiry of the term of the managing committee by 02.07.2015. As the petitioners have not evinced any interest in pursuing their cause in the writ petition and also for the above noted reasons, the Writ Petition is dismissed.
As a sequel to dismissal of the writ petition, W.P.M.P.No.51285 of 2012 filed by the petitioners for interim relief shall stand dismissed as infructuous.
