HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 23852 of 2009 Order:

This Writ Petition was filed challenging the show cause notice issued under Section 6-B of the Essential Commodities Act, 1955 in proceedings No.CSA/49/2009 dated 30.09.2009.

This Court, by order dated 05.11.2009, directed interim stay for a period of four weeks. The stay order was not extended. However, when WVMP No.1725 of 2016 was filed, the same was dismissed in view of the letter addressed by the District Supply Officer, Medak at Sangareddy to the learned Government Pleader on 07.06.2016. A perusal of the letter addressed to the learned Government Pleader shows that after issuance of the impugned order, proceedings were issued on 03.12.2009 by the Tahsildar, Sadasivapet to the Godown Incharge, Sadasivapet to hand over the seized stock to Shanmukhi Traders, the Proprietor on 12.12.2009 under a cover of panchanama. The seized lorry bearing No.KA-39-4360 was also released in favour of the Proprietor of the petitioner. In view of the same, no further orders are necessary in the present Writ Petition. The Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
