THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.4090 OF 2011 DATED 09th JUNE, 2015 Between:
M.Chinna Narsimhulu .. Petitioner and The Superintendent of Police, Kadapa District and others.
.. Respondents
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.4090 OF 2011
O R D E R
This writ petition was filed assailing the action of the police authorities in not
releasing the fifth respondent from their custody though she had attained majority. The Sub-Inspector of Police, Pendlimarri Police Station, Y.S.R.Kadapa District, filed a counter-affidavit stating that the fifth respondent was produced before the learned Special Judicial Magistrate of First Class for Prohibition and Excise Offences, Kadapa, and upon recording of her statement, she voluntarily went to Hindupur along with the petitioner.
No reply-affidavit was filed by the petitioner denying the above statement. In that view of the matter, the allegation of the petitioner that the police authorities still continue to retain custody of the fifth respondent is without basis. The writ petition is therefore dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs. ______________________ SANJAY KUMAR, J 09th JUNE, 2015 PGS
