This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri K. I{ONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.6975 OF 2O2O ORDER:

This Crimina,l Petition, under Section 438 of the Code of Criminal Procedure, L973 (Cr.P.C.), is filed by the /, petitioner/ accused, for grant of anticipatory bail in Crime No.57 of 2O2O of P.S. Wazedu, Mulugu District, registered for the offence punishable under Section 306 of the Indian Penal Code.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

In the FIR, it is inter alia stated that on 30.10.2020 the de facto complainant gave a complaint stating that the petitioner/accused took his daughter out of the house three times saying that he would marry her but he did not marry. On that his daughter was mentally depressed and vexed on life and consumed unknown pesticide poison and died. Hence, the complaint.

Learned counsel for the petitioner/ accused would submit that the petitioner is innocent of the offence and he is no way concerned with the alleged offence. The petitioner/ accused is a law-abiding citizen and is prepared to abide by any condition which this Court may deem fit to impose in case of granting anticipatory bail. Hence, he prayed to grant anticipatory bail to the petitioner/ accused.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/ accused.

As seen from the contents of the F.l.R., there are specific allegations against the petitioner/ accused that he promised the deceased to marry her and took her out of the house many times but did not marry her and so, she got depressed and died by consuming poison.

Having regard to the facts and circumstances of the case, nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner/ accused. The Criminal Petition is, accordingly, dismissed. Miscellaneous applications, if any, pending sha1l stand closed.
