THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20229 of 2019 ORDER:
This Writ Petition is filed for the following relief: "....to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in selecting the 3rd respondent for appointment of retail outlet dealership in Gummadam village of Pebbair Mandal, Wanaparthy District, pursuant to the notification published on 14.12.2018 in contravention of the guidelines issued for selection of dealers for regular and rural retail outlets as being illegal, arbitrary and unjust and consequently set aside the selection of the 3rd respondent and to appoint the petitioner herein as Retail Outlet dealer in Gummadam Village, Pebbair Mandal, Wanaparthy District."
Heard learned counsel for petitioner.
Respondent Nos.1 and 2 filed a counter-affidavit stating that the Land Evaluation Committee had inspected the site and found that the offered land in Sy.No.132/B/2/2 is not in the advertised location; that as per the guidelines, the application of the third respondent was moved to Group-3 category; that draw of lot would be conducted again for the remaining two applicants, who includes the petitioner and who were in Group-1, and that selection process has been taken place in line with the guidelines.
CKR, J W.P.No.20229 of 2019 From the above, it is evident that as of date, the third respondent is not being selected. As there being yet another applicant, the selection process is required to be proceeded with, in accordance with the procedure notified, which shall be subject to the rights of the respective parties including that of the third respondent.
Subject to the above, this Writ Petition is closed. Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 25th NOVEMBER, 2019.
