THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.3370 of 2015 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dt.01.12.2015 in Crl.MP.No.252 of 2015 in CC.No.480 of 2009 on the file of the Judicial First Class Magistrate, Andole at Jogipet. 2.

A perusal of the record shows that the petitioner is facing trial in C.C.No.480 of 2009 on the file of the Judicial First Class Magistrate, Andole for the offences punishable under Section 7(1)(a)(ii) of Essential Commodities Act, 1995. It further shows that when the petitioner failed to appear before the trial Court, having no other alternative, the trial Court issued non-bailable warrants against the petitioner on 13.10.2015. The petitioner filed Crl.MP.No.252 of 2015 to recall the non-bailable warrant issued against him, but the trial Court dismissed the said petition.

At the time of arguments, the learned counsel for the petitioner submitted that the petitioner is intending to file another application to recall the non-bailable warrants issued against him and the trial Court may be directed to consider the same.

Having regard to the facts and circumstances of the case and also submissions made by the learned counsel for the petitioner, the trial Court is hereby directed to dispose of

the petition, if any, filed by the petitioner under Section 70(2) Cr.P.C., on the same day in accordance with law. 5.

With the above directions, this Criminal Revision Case is disposed.

Consequently, the miscellaneous petitions, pending if any, shall stand closed.
