Heard Mr. P. Shashi Kiran for petitioner and Mr. G. Narender Reddy for fourth respondent.

This Court, prima facie, is not inclined to consider the writ prayer on the short ground that the petitioner ought to have availed the remedies under the Panchayat Raj Act or submitted explanation against the order dated 11.06.2016 to the Panchayat Secretary, Dammaiguda.

Learned counsel for petitioner draws the attention of the Court to Ex.P8, explanation dated 03.08.2016 submitted to Panchayat Secretary and contends that there is inaction in disposing of the explanation.

From the communication impugned in the writ petition, it is clear that straightaway orders have been passed directing the petitioner to stop construction at the subject matter of the writ petition. This Court is of the view that the communication impugned in the writ petition can be treated as show cause notice, consider explanation dated 03.08.2016, afford opportunity to petitioner and take a decision as is warranted in the fact situation of the case. Status quo, as on today in all regards, be maintained till a decision is taken. The writ petition is disposed of in above terms. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
