HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CONTEMPT CASE No.2085 of 2016 ORDER:

The present Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act stating that the respondent has willfully and deliberately disobeyed the order dated 07.06.2016 passed by this Court in W.P.No.17484 of 2016 2.

Counter came to be filed by the respondent/ contemnor stating that by an order dated 07.06.2016, this Court while disposing of the writ petition No.17484 of 2016, directed the respondent to dispose of the representation dated 12.05.2016, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of the order. After receipt of the copy of the order, the respondent issued endorsement dated 06.07.2016 which was served on the petitioner on 06.08.2016.

A reading of the endorsement dated 06.07.2016 would show that the land wherein 14 feet road was situated is a private land. In the said place the owner constructed shed and gate. The owner of the land has not submitted any plants to that affect in the office. Hence, notices are yet to be issued to the person who made unauthorized construction. The road can be divided as per the plans after the owner submitting the plans. The same was also informed to the petitioner. In view of the above, there is no contempt made by the contemnor.

Accordingly, the Contempt Case is dismissed. Consequently, miscellaneous petitions, if any, pending shall stand closed. ____________________ C. PRAVEEN KUMAR, J 26.04.2017 gkv
