ORDER

When the matter is taken up for hearing, learned Standing Counsel appearing for the respondent-Corporation submits that as claimed by the petitioner, there is no insurance policy with the Corporation to grant insurance amount to the petitioner and that the writ petition is liable to be dismissed.

Learned counsel appearing for the petitioner submits that insurance policy is with the Corporation and the claim of the petitioner has to be considered.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that the petitioner ought to have impleaded the insurance company so as to claim any insurance amount. In view of the submission made by the learned Standing Counsel that no insurance policy is with the Corporation, there are no merits in the writ petition and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed. No costs.
