SMT JUSTICE T.RAJANI CRIMINAL PETITION No.11604 of 2013 ORDER:

This petition is filed seeking for quash of the proceedings against the petitioner, who is A1, in Crime No.94 of 2013 on the file of Pedavegi Police Station, West Godavari District. The offences alleged against the petitioner are under Sections 420, 421, 422, 424, 425, 426 and 427 read with Section 34 IPC.

Heard the counsel for the petitioner, the Public Prosecutor appearing for the 1st respondent and of Sri Nimmagadda Satyanarayana, the counsel for the 2nd respondent. 3.

The Public Prosecutor files a memo stating that during the course of investigation, accusation against A2 to A4 was not established and, hence, their names were deleted from the case and the case was charge sheeted only against A1 vide C.C.No.89 of 2014 on the file of the Special Judicial Magistrate of First Class (Excise), Eluru, and the same ended in acquittal by virtue of the judgment, dated 08.02.2017, passed by the said Magistrate. 4.

Hence, in view of the above, no cause of action survives for adjudication and no further orders are necessary. 5.

Accordingly, the criminal petition is dismissed as infructuous.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
