This appeal is filed by A.P. State Road Transport Corporation under Section 173 of the Motor Vehicles Act, 1988 (for short 'the Act'), aggrieved by the award dated 16.09.2009 passed by the Chairman, Motor Accidents Claims Tribunal-cum-District Judge, Ongole, in O.P.No.473 of 2007. 2.

The respondents herein filed the above O.P under Section of the Act, claiming compensation of Rs.5,00,000/- on account of the death of the deceased P.Peddanna, aged 27 years, in a motor vehicle accident, that occurred on 14.12.2006 at about 8.30 a.m. near Kunchepalli on Podili-Darsi Road.

The Tribunal has passed the impugned award granting compensation of Rs.3,48,000/- with interest at 9% p.a. Dissatisfied with the quantum of compensation, the claimants, who are respondents herein have preferred MACMA No. 75 of 2010 before this Court and this court by judgment and decree dated 07.02.2017, on considering overall evidence, allowed the appeal in part enhancing compensation from Rs.3,48,000/- to Rs.3,80,250/- with interest at 7.5% p.a.

The present appeal is filed against the same award dated 16.09.2009 passed in the same MVOP No. 743 of 2007 by the Respondent Corporation. Inasmuch as MACMA No. 75 of 2010 filed by the claimants, is allowed in part by judgment and decree dated 7.2.2017 enhancing the compensation, there are no grounds to interfere with the impugned award passed by the Tribunal. Consequently, the appeal is dismissed. No order as to costs. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. ----------------------- (ANIS, J) 23.08.2017 MAS
