THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.721 of 2017 ORDER:

When it is brought to the notice of this Court that in Writ Petition No.46677 of 2016 filed by Accused Nos.1 and 3 in the very same First Information Report, this Court, by order dated 02.01.2017, while issuing notice, stayed further proceedings including the arrest of the petitioners therein, a copy of which is filed in the material papers, this Court proposed to make a request to the Hon'ble the Acting Chief Justice for a direction to post this Criminal Petition also before the Court hearing Writ Petition No.46677 of 2016 for deciding the same along with the said Writ Petition.

However, at this stage, learned counsel for the petitioner/ Accused No.2 seeks permission to withdraw the present petition.

Acceding to the request of learned counsel for the petitioner, the Criminal Petition is dismissed as withdrawn. It is needless to mention that the petitioner can work out the remedies as are available to him in accordance with law.

Miscellaneous applications, if any pending in the present petition, stand closed.
