THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.22011 of 2009 ORDER:

When the matter is called, it is represented by learned counsel for the petitioners so also the learned Government Pleader for Panchayat Raj for respondents that in view of the interim order passed by this Court in W.P.M.P.No.28591 of 2009, dated 14-10-2009 no further orders are necessary in this writ petition and the writ petition can be disposed of in terms of the interim order, dated 14-10-2009. The said interim order reads as follows:

"The interim direction issued in W.P.M.P.No.18926 of 2009 in W.P.No.14433 of 2009 is placed before this Court.

The learned Assistant Government Pleader for Panchayat Raj, however states that no doubt G.O.Ms.Nos.271, 272, 231 and 236 may govern the field, but, however, the learned Assistant Government Pleader for Panchayat Raj would point out that no particulars or details had been furnished in the affidavit filed in support of the Writ Petition and vague directions had been prayed for.

As can be seen from the contents of the G.O.s relating to certain works, the Gram Panchayats are having a right of entitlement, but these rights cannot be said to be exclusive since there are certain exceptions. However, it is needless to say that respondent Nos.2 to

4 are bound to follow the G.O.s governing the field in relation to the entrustment of works.

In the light of the same, interim direction to respondents to follow what had been specified in the G.O.s aforesaid while making entrustment of works to the petitioners until further orders."

Recording the said submission, the writ petition is disposed of, making the said interim order as final order in the writ petition. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
