This Writ Petition is filed assailing the action of the 5th respondent in issuing impugned notice No.1117/EO/E2/GHMC/2019/167, dated 08.08.2019 and notice No.1117/EO/E2/GhMC/2019/206, dated 04.09.2019 without considering the payments and also written representations made by the petitioner.
Heard learned counsel for the petitioner and Sri Chatla Madhu, learned Standing Counsel for the respondents 2 to 5. This Court passed interim order on 20.09.2019 as under: "Notice before admission.
Pending disposal of the Writ Petition, there shall be a direction to the respondents not to evict the petitioner subject to the condition of his depositing 50% of the arrears as demanded in the notice dated 04.09.2019 within a period of two (2) weeks from today, and further furnishing bank guarantee in favour of the fifth respondent-Estate Officer, GHMC, O/o the Commissioner, Estate Section, Head Office, GHMC, Tank Bund, Hyderabad, for the balance 50% of the amount along with interest @ 12% per annum. If the petitioner fails to comply with the same, the respondents shall be entitled to evict the petitioner without further recourse to this Court. Post on 14.10.2019 in motion list."
Both the learned counsel submits that this Writ Petition can be disposed of in terms of the interim order. Recording the submission of both the learned counsel, this Writ Petition is disposed of directing the respondents to consider the representations of the petitioner dated 07.02.2019, 09.07.2019, 22.08.2019, 07.09.2019 and 11.09.2019 and take appropriate action, in accordance with law. Till then, the
respondents shall not evict the petitioner from the subject premises. However, continuance of the petitioner in the subject premises, will be subject to the result of the action taken by the respondents on the representations of the petitioner. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY, J 18-11-2019 kvs
