The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.8349 of 2025 Order:

This Criminal Petition is filed by the petitioner/accused under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) seeking regular bail in connection with Crime No.720 of 2025 on the file of the Station House Officer, Vanasthalipuram Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 69 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

Heard Mr.V.Ram Mohan Reddy, learned counsel for the petitioner/accused and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent/State. 3.

Case of the prosecution is that on 27.05.2025 at 1630 hours, the complainant reported that while working at Owaisi Hospitals, Hyderabad in 2020, the accused, Rupavath Anil Kumar, proposed to her and promised marriage. Trusting his words, she accepted. They met regularly at her rented residence in BN Reddy Nagar, and he engaged in sexual relations with her under the false pretense of

marriage. In April 2023, he secured a government nursing job at Area Hospital, Nalgonda, and continued to promise to marry her. However, in April 2025, he started avoiding her citing family issues. On 24.05.2025, she visited the hospital to meet him, but he was unavailable. Over a phone call, he told her they should separate and revealed he had already married another woman. She then realized he had deceived her. Basing on the same, present crime was registered.

Learned counsel for the petitioner/accused submits that the petitioner has not committed any offence and he was falsely implicated in the aforesaid crime. He further submitted that petitioner has never given any false promise to marry the victim, hence the ingredients under Section 69 of BNS are not attracted. He further submitted that petitioner was arrested on 04.06.2025 and since then he is in judicial custody and the entire investigation is completed except filing of chargesheet. He further submitted that petitioner is working as a Nursing Officer in Government Area Hospital, Nalgonda and the petitioner is not having any criminal antecedents and therefore, he may be granted bail as he is ready and

willing to cooperate with the investigation and abide by the conditions that may be imposed by this Court. 5.

Per contra, learned Additional Public Prosecutor submits that the petitioner/accused committed grave offence and the de facto complainant in her complaint specifically mentioned that petitioner has given a false promise to marry her and developed physical relationship with her and the investigation is under progress and if the petitioner is enlarged on bail at this stage, he will interfere with the investigation and influence the witnesses. Hence, he prays to dismiss this criminal petition.

Having heard learned counsel for the parties and on perusal of the record and complaint, it reveals that the complaint the petitioner and victim are known to each other since, 2020 and the petitioner was arrested on 04.06.2025, since then he was in judicial custody. Even according to the learned Additional Public Prosecutor 14 witnesses were examined and the petitioner is not having any criminal antecedents.

In view of the same, this Court is inclined to grant bail to the petitioner/accused subject to the following conditions:

(i) The petitioner/accused shall execute a personal bond for a sum of Rs.30,000/-(Rupees Thirty Thousand only) with two sureties for a like sum each to the satisfaction of the VII Additional Junior Civil Judge-cum-VII Additional Metropolitan Magistrate, Cyberabad, Ranga Reddy District.

(ii) On such release, the petitioner/accused shall appear before the concerned Station House Officer at 11.00 A.M., on every Monday, for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required. (iii) After release, petitioner/accused shall not influence the witnesses or interfere with the investigation.

(iv) After release, the petitioner/accused shall not try contact the victim or her family members in any manner.

(iv) The petitioner/accused shall abide by the conditions stipulated in Section 483 (3) of BNSS.

Accordingly, the Criminal Petition is allowed.

As a sequel, miscellaneous petitions, pending if any, stand closed.
