O R D E R

This writ petition was filed by two companies assailing the alleged inaction on the part of the Registrar of Companies in not passing appropriate orders upon the complaint dated 29.03.2004 made by them.

The Registrar of Companies filed a counter-affidavit as long back as on 21.07.2004, wherein he stated that he had no role to play in the matter under the provisions of the Sick Industrial Companies (Special Provisions) Act, 1985 and he therefore could not take any action upon the petitioners' complaint. No reply affidavit was filed to this counteraffidavit. It is therefore clear that the grievance of the petitioners is completely misplaced as the Registrar of Companies was not the authority to address the issue.

The Writ Petition is accordingly dismissed. This order shall however not preclude the petitioner companies from approaching the proper authorities for redressal of their grievance in accordance with law, if permissible. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
