HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24464 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus challenging the action of the respondents, more particularly the 3rd respondent in mutating the name of B.Parvathamma in the place of B.Ramulaiah in Grampanchayat records for the house bearing H.No.7-145, Amangal village and Mandal, Mahaboobnagar District vide proceeding No.279/2007, dated 23-11-207 without issuing any notice to the legal heirs of Late B.Ramulaiah and also in not considering the representation made by the petitioner dated 18.05.2016 to the 2nd respondent as illegal and arbitrary and consequently direct the second respondent to consider the representation of the petitioner dated 18.05.2016. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development and Sri G.Narender Reddy, learned standing counsel appearing for respondents 2 to 4.

The case of the petitioner is that the fifth respondent issued the mutation proceedings No.279/2007 dated 23.11.2007 without issuing any notice to the petitioner.

Learned counsel for the petitioner submitted that the petitioner made a representation to the second respondent - District Panchayat Officer on 18.05.2016. The only request made by the learned counsel for the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated

18.05.2016.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation of the petitioner dated 18.05.2016 in accordance with law as early as possible, preferably, within a period of one month from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
