THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9369 OF 2017 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for the first respondent and learned standing counsel for the second respondent.

The petitioner states that it is a registered Society under the Societies Registration Act and functioning from Chittoor. The third respondent was its President. A general body was conducted on 02.03.2017 and the third respondent was removed from the Office of the President. A new President was elected. However, the third respondent is continuing his activities styling himself as the President of the petitioner Society. In those circumstances, seeking intervention by the second respondent, the present writ petition was filed.

Learned counsel for the petitioner could not show the jurisdiction of the second respondent to intervene in the affairs of the petitioner Society and in the facts and circumstances mentioned above, in the absence of any duty cast on the second respondent, no writ can be issued. The writ petition is accordingly dismissed. However, it will not prevent the petitioner from availing appropriate remedies in accordance with law. Miscellaneous petitioner, if any pending, in this writ petition, shall stand closed.
