O R D E R

This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused Nos.3 to 7 seeking to enlarge them on bail in connection with Crime No.70 of 2026 of Chinthalapalem Police Station, Suryapet District. The offences alleged against the petitioners are punishable under Sections 109 and 126 (2) read with 3 (5) of the BNS Act.

The case of the prosecution is that on 28.05.2026, the de facto complainant came to the police station and lodged a report stating that while the victims were proceeding on bike to his daughter's house for celebrating Bakrid festival and when the bike crossed the tractor, which was driven by Accused No.1, accused No.2 was sitting beside accused No.1, hit the bike and also tried to run over by them. It is stated that previously also accused No.1 was attempted to kill by keeping personal grudge. It is further alleged that later about 45 persons attacked the house of the Sarpanch having in possession of axes. Hence, he requested the police to take necessary action against the petitioners. Basing on the same, police registered a case against the petitioners and others for the aforesaid offences.

Heard Sri P.Nagendra Reddy, learned counsel for the petitioners/Accused Nos.3 to 7 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of learned counsel for the petitioners is that the petitioners are innocent of the offences alleged against them; that in respect of accused

Nos.3 to 7, there are no specific overacts against them; that the specific overacts are only against A.1 and A.2 and they also lodged a report before police with similar allegations and the same was registered as a case in Crime No.71 of 2026; that all other accused were granted Anticipatory bail; that these petitioners in judicial custody since 30.05.2026; that material part of the investigation is completed and hence, he prays this Court to grant bail to the petitioners. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioners are grievous in nature; that the victims sustained fracture injuries; that the investigation is not yet completed and therefore, requested this Court to dismiss the petition. 6.

Considering the submissions made by learned counsel for petitioners and learned Additional Public Prosecutor, the petitioners have been in judicial custody since 30.05.2026. As seen from the record, material part of the investigation is completed by examining L.Ws.1 to 8. The other accused were granted Anticipatory Bail with similar allegations. Considering the same, this Court

deems it fit to grant bail to the petitioners/Accused Nos.3 to 7 subject to the following conditions:

(i) The petitioners-accused Nos.3 to shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Huzurnagar.

(ii) On such release, the petitioners-accused Nos.3 to 7 shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioners-accused Nos.3 to 7 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 7.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
