HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.4048 of 2016 ORDER:

The inaction of respondent No.2, in investigating into FIR No.4 of 2015 on the file of Gudipalli Police Station, Chittoor District, and filing charge sheet, is questioned in the Writ Petition as being illegal and arbitrary. Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home (AP). Learned Assistant Government Pleader for Home (AP) submits that investigation has been completed and final report was filed on 15.02.2016 stating the complaint as 'false' before the Judicial Magistrate of First Class, Kuppam.

In view of the fact that investigation has been completed and final report has been filed referring the case as 'false', the cause in the Writ Petition does not survive necessitating any further adjudication by this Court. The Writ Petition is, accordingly, closed. However, petitioner is at liberty to pursue his remedy in appropriate forum, if so advised. Miscellaneous Petitions pending, if any, shall also stand closed.
