THE HONOURBLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 8345 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) by the petitioners/accused Nos.1 to 6 seeking anticipatory bail in the event of their arrest in Crime No.101 of 2025 of Choppadandi Police Station, Karimnagar District, registered for the offence punishable under Section 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

The case of the prosecution, in brief, is that on 08.05.2025, the de facto complainant lodged a complaint stating that his elder son, Undati Sathaiah, had committed suicide by hanging himself with a saree from an iron pipe at their house, as he was unable to tolerate the constant physical and mental torture and harassment inflicted upon him by the accused persons over family matters. Hence, the complaint.

Heard Mr. K. Mallikarjun, learned counsel, representing Mr. M. Ramesh Goud, , learned counsel for the petitioners,

and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondents State. 4.

Learned counsel for the petitioners submitted that the petitioners have not committed the alleged offence and they were falsely implicated in the present crime. Even according to the allegations made in the complaint, the ingredients under Section 108 of the BNS are not attracted against the petitioners. The petitioners never instigating or provoked the deceased to commit suicide. He further submitted that petitioner Nos.1 and 2/accused Nos.1 and 2 are senior citizens and petitioner No.3 is having small children. Insofar as petitioner Nos.4 to 6/accused Nos.4 to 6 are concerned, there are no specific allegations against them. The petitioner Nos.4 to 6/accused Nos.4 to 6 were implicated in this crime only on the ground that they are the relatives of petitioner Nos.1 to 3/accused Nos.1 to 3. The petitioners are ready and willing to cooperate with the investigation and also comply with the conditions, which are going to be imposed by this Court. Hence, the petitioners may be granted anticipatory bail.

Per contra, learned Additional Public Prosecutor submitted that the petitioners have committed grave offence. There are specific allegations levelled against each petitioner. At the instance of the petitioners, the deceased committed suicide. The investigation is under progress. At this stage, if the petitioners are granted anticipatory bail, they will interfere with the investigation and also influence the witnesses. 6.

Having considered the rival submissions made by the respective parties and after perusal the material available on record, it reveals that there are specific allegations levelled against the petitioner Nos.1 to 3/accused Nos.1 to 3, who are the father-in-law, mother-in-law and wife of the deceased, that they harassed the deceased and at their instigation, the deceased committed suicide. Even according to the learned Additional Public Prosecutor, the investigation is under progress.

Taking into consideration the facts and circumstances of the case and the gravity of the offence, this Court is not inclined to grant bail to petitioner Nos.1 to 3/accused Nos.1 to 3.

Insofar as petitioner Nos.4 to 6/accused Nos.4 to 6 are concerned, there are no specific allegations against them and they are the relatives of petitioner Nos.1 to 3/accused Nos.1 to

3. Even according to the learned Additional Public Prosecutor, petitioner Nos.4 to 6/accused Nos.4 to 6 are not having any criminal antecedents. Hence, this Court is inclined to grant bail to petitioner Nos.4 to 6/accused Nos.4 to 6 subject to the following conditions.

(i) Petitioner Nos.4 to 6/accused Nos.4 to 6 are directed to surrender before the S.H.O., Choppadandi Police Station, Karimnagar District, on or before 19.07.2025 and on such surrender, they shall be enlarged on bail on executing personal bonds for a sum of Rs.20,000/-(Rupees twenty thousand only) each with two sureties for a like sum each.

(ii) On such release, Petitioner Nos.4 to 6/accused Nos.4 to 6 shall appear before the S.H.O., Choppadandi Police Station, Karimnagar District, on every Tuesday at 11:00 a.m. commencing from 22.07.2025 for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier. (iii) Petitioner Nos.4 to 6/accused Nos.4 to 6 shall abide by the conditions stipulated under Section

482 (2) of the BNSS and shall cooperate with the Investigating Officer in the investigation.

Accordingly, the Criminal Petition is allowed in respect of petitioner Nos.4 to 6/accused Nos.4 to 6. Insofar as petitioner Nos.1 to 3/accused Nos.1 to 3 are concerned, the criminal petition stands dismissed.

Miscellaneous applications, pending if any, shall stand closed.
