THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.20429 of 2019 ORDER:
This writ petition is filed seeking to issue a writ of Mandamus to declare the action of the respondents in not complying with the terms of contract, as arbitrary and illegal and consequently direct the respondents to reimburse/refund the differential amount between 30% and 10% being deducted towards seigniorage in the same account bill.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.
3. Learned counsel for the petitioner submits that the petitioner made a representation on 31.08.2019 to the 3rd respondent requesting to reimburse an amount of Rs.37,08,366/-, which was recovered in CC-V bill, and not to recover further in running bills, but the 3rd respondent is not considering the same. He further submits that the writ petition may be disposed of with a direction to the competent authority to consider the representation and take action within a time limit.
4. In view of the submission made by the learned counsel for the petitioner, without expressing any opinion on the merits of the case, the competent authority is directed to dispose of the representation made by the petitioner in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this
order. No order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
