HON'BLE SRI JUSTICE U.DURGA PRASAD RAO AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.17287 of 2018 ORDER: (Per Hon'ble Sri Justice U. Durga Prasad Rao) In this Writ petition filed under Article 226 of the Constitution of India, the petitioner seeks an order in the nature of Writ of Habeas Corpus to direct the respondents to produce the petitioner's son by name Dasari Srinivasa Rao S/o. Late Dr. Dasari Venkateshwara Rao before the Court, who is illegally confined by respondents 4 and 5 at the instance of respondents 6 and 7.

2) Notice was taken on behalf of respondents 1 to 4 by Sri P. Mohith Rao, learned counsel representing on behalf of Additional Advocate General for the State of Telangana. Notice to respondents 5 to 7 is yet to be ordered.

3) While-so, when the matter came up for hearing in the form of House Motion moved by learned counsel Sri B.Sudhakar Reddy, Sri P. Mohith Rao, learned counsel representing the Additional Advocate General for the State of Telangana, would submit that the Police of Punjagutta PS have registered a case in Crime No.201/2018 dt.02.05.2018 on the complaint lodged by the 7th respondent and during the course of investigation, the police have apprehended the petitioner's son-Dasari Srinivasa Rao today morning i.e, on 05.05.2018 at 11:00am in Srinagar Colony, near Udipi Hotel and after

completing the formalities, the police would produce him before the XIV Additional Chief Metropolitan Magistrate, Nampally, within due course.

4) In view of the above submission of Sri P.Mohith Rao, learned counsel representing on behalf of Additional Advocate General for the State of Telangana, this Writ Petition is closed giving liberty to the petitioner to pursue her legal remedies for securing release of her son-Dasari Srinivasa Rao.

5) Learned counsel for petitioner would submit that for illegal detention of petitioner's son by the respondents, liberty may be given to the petitioner to pursue the legal course available to them for claiming damages and other remedies available under law. 6) Needless to emphasize, the petitioner if so advised and if law permits, can pursue the legal courses available to them. As a sequel, miscellaneous petitions if any pending in this petition, shall stand closed.
