Today when this matter is taken up, the learned counsel for the petitioner sought permission to withdraw the petition inter alia submitting that the suit is dismissed for default and hence, the petitioner is withdrawing the petition. However, he sought liberty to file a fresh petition as and when the suit is restored. 2.

Recording the said submission, this Transfer CMP is dismissed as withdrawn reserving liberty to the petitioner as sought for. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Transfer CMP, shall stand closed.
