THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20338 OF 2019 O R D E R:

Petitioner is aggrieved of the inaction of the respondent authorities in receiving and registering the sale deed submitted by him in respect of plot bearing No. 75, Southern Paradise Phase-I, in Survey No. 725/6, admeasuring 325.55 square yards situated at Shamshabad Village and Mandal, Ranga Reddy District and therefore, seeks a direction to the respondent authorities to receive and register the sale deed.

Heard learned counsel for the petitioner and learned Government Pleader for Stamps & Registration. Learned counsel for the petitioner submits that the issue in this Writ Petition is squarely covered by the order passed by this Court in Writ Petition No. 19069 of 2014 dated 25.08.2014. The said submission is not disputed.

The operative portion of the order dated 25.08.2014 reads as under:

" Hence, the Writ Petition is disposed of directing the SubRegistrar to receive and process the deeds of conveyance without reference to the District Gazette notification dated 26.09.2013 in accordance with the Indian Registration Act, 1908 and the Indian Stamp Act, 1899. However, it is open to the registering authority to refuse to register the deeds presented before him, if he has any other objection, by duly assigning reasons in support of such decision and communicate the decision to the petitioner. It is made clear that mere registration of deed of conveyance does not confer title to the property and it is made clear that this order does not preclude the Government to take appropriate steps as warranted by law and to assert its title."

This Writ Petition is also disposed of in terms of the aforesaid order in Writ Petition No. 19069 of 2014. No costs. The miscellaneous Applications, if any shall stand closed. ___________________________ CHALLA KODANDA RAM, J 19th September 2019 ksld
