HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7217 of 2015 ORDER :
The present criminal petition is filed by the petitioner/A-11 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.11 of 2012 of Pasara Police Station, Warangal District registered for the offences punishable under Sections 120-B, 403, 406, 420 read with 34 I.P.C.
2) Heard the learned counsel for the petitioner as well as the 1st respondent-State represented by the Public Prosecutor before admission and before ordering notice to the 2nd respondent and perused the material on record.
3) On perusal of the material on record, the facts fall short to admit the petition for quashing under Section 482 Cr.P.C but the petitioner entitled to concession of regular bail and the petitioner is at liberty to surrender before the learned Magistrate and move for regular bail with notice to the A.P.P concerned and in such an event, the learned Magistrate shall grant bail with necessary conditions. Needless to say the learned Magistrate can dispense with the presence of the petitioner at post bail stage. Further remedies, if any, to the petitioner after filing final report and after taking cognizance by the learned Magistrate, are left open.
4) With the above observations, the criminal petition is disposed of.
