THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7288 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.132 of 2023 on the file of Wadapally Police Station, Nalgonda District, registered for the offences under Sections 354 (D) and 305 of IPC and Section 12 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The daughter of the de-facto complainant committed suicide. The complaint was filed suspecting the role of this petitioner. The victim girl was a minor studying Intermediate.

During the course of investigation, the Police found that in the year, 2019, the petitioner was following victim

girl and forcing her to accept his love. However, he went Dubai in the year, 2021 and came back and again he started following the girl asking her to accept his love and marry him. Unable to bear the said harassment of the petitioner, the victim girl committed suicide. 5.

Learned Additional Public Prosecutor on instructions would submit that there is no suicide note of the deceased girl. However, on account of constant following of the petitioner, she committed suicide. 6.

The petitioner was arrested and remanded to custody on 14.07.2023. The allegation in the complaint is that he was following victim girl asking her to marry him and accept his love. There are no instances of physical assault or any physical abuse by the petitioner. As seen from the remand report, material part of the investigation is complete. For the said reason, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty

Five thousand only) with two sureties for a like sum each to the satisfaction of II Additional Judicial First Class Magistrate, Miryalaguda. ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks or until the charge sheet is filed, whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
