THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.4331 OF 2015 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents in opening the rowdy sheet against the petitioner as illegal and arbitrary, and consequently to quash the same. Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in three criminal cases in 2003 and 2004 and that he was acquitted in all the cases. He further submits that on earlier occasion also, the petitioner filed W.P.No.8460 of 2005 for closure of the rowdy sheet and that this Hon'ble Court directed the respondents to consider the application of the petitioner if no cases are registered from the institution of the said writ petition. In spite of the said orders, the respondents did not close the rowdy sheet against the petitioner. Hence, he prays this Court to direct the respondents to close the rowdy sheet against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a fresh representation to the respondents 2 and 3 stating all the reasons for closure of the rowdy sheet and on filing of such application, the respondents 2 and 3 are directed to consider the representation and pass appropriate orders as expeditiously as possible, preferably within a period of two months from the date of application of the petitioner. Further, the respondents 2 and 3 are directed not to compel the petitioner to come to the Police Station.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
