THE HON'BLE SRI JUSTI CE T. VI NOD KUMAR AND THE HON'BLE SRI JUSTI CE PULLA KARTHI K W.P.No.27775 of 1996, RC Nos.2 and 3 of 1997 COMMON ORDER:(per Hon'ble Sri Justice T.Vinod Kumar) Learned counsel appearing for the petitioners submits that the 1st petitioner has since deceased and insofar as the 2nd petitioner is concerned, though he has addressed a letter, the same has been returned with postal endorsement 'not found'. Therefore, he submits that he has no instructions in the matter.

2.

Sri B.Narasimha Sarma, learned Senior Standing Counsel appearing for the respondents, on the other hand, submits that the cause in the Writ Petition as well as in RCs, which are preferred at the instance of the petitioners, may not survive for adjudication by this Court, due to passage of time.

3.

Having regard to the submissions made, since it is reported to this Court by the learned counsel for the petitioners that he has no instructions in the matter and as the writ petition relates to the year 1996 and RCs relate to the year 1997, this Court is of the view that the cause in these matters does not survive for consideration any further.

4.

In view of the same, the Writ Petition as well as RCs are closed. However, liberty is granted to the petitioners to seek revival, in the event cause survives.

5.

Miscellaneous petitions, if any, pending in these matters shall stand closed. No order as to costs.
