HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11438 OF 2012 O R D E R :

This writ petition is filed declaring the action of the respondents in not considering the request of the petitioner for taking necessary steps to release the amounts in respect of the works done for formation of CC Roads in Issapalem Gram Panchayat, Narasaraopet Rural Mandal, Guntur District pursuant to the work orders in Roc.No.03/2011 and 03-1/2011, dated 08.12.2011 issued by the 5th respondent, as illegal and arbitrary. Though this Court adjourned the matter several times for filing counter by the 5th respondent, the 5th respondent failed to file counter. As such this Court on 29.02.2016 imposed costs of Rs.2000/-.

Today when the matter is taken up for hearing, Sri Ravi Cheemalapati, learned Standing counsel for the 5th respondent submits that that costs imposed have been paid vide USR.No.16872 of 2017 dated 08.06.2017.

Learned counsel for the petitioner submits that petitioner made a representation to the respondent authorities requesting them to release the amounts due to him in respect of the works executed by him for formation of CC Roads in Issapalem Village, when he was in the capacity of Sarpanch.

Learned Standing counsel for 5th respondent submits that if petitioner makes necessary application, the same will be considered and necessary action will be initiated.

In view of the above facts and circumstances, the writ petition is disposed of granting liberty to the petitioner to make necessary application to the respondents 4 and 5 by enclosing the relevant documents. On such application being made by the petitioner, the respondents 4 and 5 are directed to dispose of the same and take action accordingly within period of four (04) weeks from the date of making of application by the petitioner. No costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed.
