HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5890 of 2019 O R D E R :

This Criminal Petition is filed by the petitioner/A.2 under Section 482 Cr.P.C. seeking return of his Passport bearing No.H4358533, which was seized and surrendered before the Court of the learned XI Additional Chief Metropolitan Magistrate, Secunderabad, in C.C.No.1224 of 2016.

Heard learned counsel for the petitioner/A.2 and the learned Additional Public Prosecutor appearing for the respondent - State. Perused the material on record. Learned counsel for the petitioner contends that while granting bail, the petitioner's Passport was seized by the Magistrate concerned in C.C.No.1224 of 2016 and the petitioner intends to visit Holy Pilgrimage of Maccah to perform Umrah and also wants to renew his Passport, which expired on 22.06.2019, and that the petitioner is ready to abide by any of the conditions imposed by this Court for return of his Passport. It is also contended that the application filed by the petitioner seeking return of his Passport was dismissed by the Court below vide order dt.11.03.2019 in Crl.M.P.No.35 of 2019 in C.C.No.1224 of 2016 and hence sought for return of the Passport of the petitioner.

GSD, J Crl.P.No.5890 of 2019 On the other hand, the learned Additional Public Prosecutor opposed the relief sought in this Criminal Petition. Having regard to the facts and circumstances of the case, since the petitioner intends to visit Holy Pilgrimage of Maccah to perform Umrah and also wants to renew his Passport, which expired on 22.06.2019, the learned XI Additional Chief Metropolitan Magistrate, Secunderabad, is directed to return the Passport bearing No.H4358533 of the petitioner/A.2, which was seized in C.C.No.1224 of 2016, only for a limited period of three months on condition of the petitioner/A.2 furnishing a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only). Immediately after completion of three months period, the petitioner/A.2 shall surrender his Passport before the said Court without any delay.

Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
