THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.7110 of 2012 ORDER :

This writ petition is filed to declare the action of the respondents particularly the 2nd respondent in inserting the names of respondents 3 to 5 in respect of Ac.1.44 cents in Sy.No.572, Ac.1.43 cents in Sy.No.572 and 90 cents and 92 cents in Sy.No.571/1 & 571/2 of Mamillapalli village in Chinthakomma Dinne Mandal, Kadapa District, in the revenue records though the assignment granted in favour of the petitioner's husband in Dis.No.870/DKT/64, dated 29.06.1955 is not cancelled, as illegal, unjust, arbitrary, without jurisdiction, malafide, misuse of official power, motivated, for extraneous reasons and against statutory provisions including Board Standing Orders and against Article 300-A of the Constitution of India and consequently direct the 2nd respondent to remove the names of respondents 3 to 5 in respect of Ac.1.44 cents in Sy.No.

572, Ac.1.43 cents in Sy.No.572 and 90 cents and 92 cents in Sy.No.571/1 and 571/2 of Mamillapalli village in Chinthakomma Dinne Mandal of Kadapa District in the revenue records such as 1-B register and Adangals and to cancel assignments, if any in favour of respondents 3 to 5 in respect of the respective lands.

2. When the matter was listed on 27.01.2016, it was reported that petitioner has died and hence sought time for bringing the legal representatives of the petitioner on record and matter was adjourned by three weeks.

When the matter was listed on 17.02.2016, the same request is made and the matter is adjourned by four weeks and when the matter was again listed on 16.03.2016, the same request is made and the matter is listed for orders. Even today the same request is made by the learned counsel for the petitioner.

4. In view of the same, the writ petition gets abated and the same is accordingly dismissed as abated. Interim order granted on 16.03.2012 shall stand vacated. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
